1. Acceptance of Terms

By accessing and using the Fortal MD website, as well as by purchasing our web development, hosting, or design services, you agree to comply with and be bound by these Terms and Conditions.
If you do not agree with any of these terms, please do not use our services. We reserve the right to update this document at any time, with changes taking effect immediately upon publication on the website.

2. Description of Services

Fortal MD provides integrated digital solutions, including but not limited to:

• Website development and design (presentation websites, e-commerce, web applications)

• Web hosting services and technical maintenance

• Visual identity creation (branding) and UI/UX design

The exact parameters of each project (deliverables, timelines, costs) will be defined in a separate contract or technical annex signed by both parties before the start of work.

3. Client Obligations

To ensure the proper execution of the project, the client agrees to:

• Provide all necessary materials (texts, images, logos, information) on time, according to the agreed schedule.

• Give clear and constructive feedback during the review stages.

• Hold the copyright for any materials (text, images, video) provided for inclusion in the project.

Delays in providing materials or feedback from the client will automatically result in an extension of the project delivery deadline.

4. Pricing and Payments

All prices for our services are provided based on a custom quote. The standard payment terms are as follows:

• Deposit: A percentage deposit (typically 40% - 50%) of the total project value is required to start the work.

• Final Payment: The remaining balance is due upon project completion, before deployment to the final server or delivery of the source code.

• Recurring services (e.g., web hosting, maintenance) are paid in advance for the agreed period (monthly or annually).

5. Intellectual Property

Until full payment of the project is made, all intellectual property rights to the design, source code, and any other materials created by Fortal MD remain our property.

After full payment, the rights to use and exploit the final product are transferred to the client. However, Fortal MD reserves the right to include the completed project in its portfolio for promotional purposes, unless a strict Non-Disclosure Agreement (NDA) has been signed.

6. Limitation of Liability

We are not liable for:

• Loss of profits, data, or other indirect damages resulting from the use or inability to use the delivered products.

• Issues caused by third parties (e.g., hosting server outages not directly managed by us, updates to third-party platforms, cyberattacks).

• Content provided by the client and displayed on the developed website.

7. Disputes and Contact

Any dispute between Fortal MD and the client shall be resolved amicably. If this is not possible, the dispute will be settled by the competent courts of Chișinău, in accordance with the laws of the Republic of Moldova.
